Stars and Empires: Colony Defense End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Elemental Legion ("we," "us," or "Elemental Legion"), the developer and sole owner of Stars and Empires: Colony Defense (the "Game") and the Stars and Empires brand. By installing, accessing, or using the Game, you agree to be bound by this EULA. If you do not agree, do not install or use the Game.
1. Grant of License
1.1 Limited License: Elemental Legion grants you a non-exclusive, non-transferable, revocable license to use Stars and Empires: Colony Defense for personal, non-commercial purposes, subject to this EULA. The Game is licensed, not sold, and you do not acquire ownership of the Game or its content.
1.2 Scope of License: This license permits you to install and play the Game on devices you own or control. You may not sublicense, rent, lease, sell, or distribute the Game or any portion thereof.
2. Ownership and Intellectual Property
2.1 Ownership: All rights, title, and interest in Stars and Empires: Colony Defense and the entire Stars and Empires brand, including but not limited to code, graphics, sound effects, music, text, designs, trademarks, trade dress, and other content (collectively, "Brand Content"), are owned by Elemental Legion or its licensors. The Game, the Stars and Empires brand, and all Brand Content are protected by copyright, trademark, and other intellectual property laws worldwide.
2.2 Music Rights: Elemental Legion owns all rights to the music and audio in Stars and Empires: Colony Defense and any other Stars and Empires branded products. You are granted a limited license to experience the music solely through gameplay and may not reproduce, distribute, perform, or create derivative works of the music.
2.3 User-Generated Content: Any content you create using Brand Content (e.g., mods, skins, or fan works derived from Stars and Empires: Colony Defense or the Stars and Empires brand) is considered a derivative work and belongs to Elemental Legion. You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and distribute such content.
3. Prohibited Uses
You may not engage in any of the following without prior written permission from Elemental Legion:Reproduce, copy, modify, distribute, or create derivative works of any Brand Content, including assets from Stars and Empires: Colony Defense or any other Stars and Empires branded products.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game or any Stars and Empires branded products.
Circumvent, disable, or tamper with any digital rights management (DRM) or technical protection measures.
Use Brand Content for commercial purposes, including in other products or services.
Share, transmit, or make available any Brand Content to third parties.
Data mine, scrape, or extract data from the Game or any Stars and Empires branded products.
Use cheats, hacks, or unauthorized third-party software to modify or access the Game or any Stars and Empires branded products.
4. Online Features and Discontinuation
4.1 Online Services: Certain features of Stars and Empires: Colony Defense, such as multiplayer modes, may require an internet connection and access to our servers. We reserve the right to modify, suspend, or discontinue online services for the Game or any Stars and Empires branded products at any time without notice or liability.
4.2 No Obligation for Continued Access: You acknowledge that Stars and Empires: Colony Defense, including online features, may become unavailable or unsupported at our discretion. We are not obligated to provide continued access to the Game, its servers, its source code, or any Stars and Empires branded products, nor are we required to release offline modes or patches after discontinuation.
4.3 Offline Mode: If Stars and Empires: Colony Defense includes an offline mode, it is provided as-is, with no guarantee of perpetual functionality or support.
5. Permissions and Licensing
To use Brand Content outside the scope of this EULA (e.g., for streaming, modding, or commercial purposes related to Stars and Empires: Colony Defense or the Stars and Empires brand), you must obtain prior written permission from Elemental Legion. Contact us at starsandempires@gmail.com. Any granted licenses are non-exclusive, non-transferable, revocable, and subject to terms we specify.
6. Infringement and Enforcement
6.1 Enforcement: Elemental Legion will enforce its intellectual property rights in Stars and Empires: Colony Defense and the Stars and Empires brand to the fullest extent permitted by law. Infringement may result in civil and criminal penalties, including damages, legal fees, and injunctive relief.
6.2 Reporting Infringement: To report suspected infringement of Stars and Empires Brand Content, contact us at starsandempires@gmail.com.
7. Limitation of Liability
To the maximum extent permitted by law:Elemental Legion is not liable for any direct, indirect, incidental, or consequential damages arising from your use of Stars and Empires: Colony Defense or any Stars and Empires branded products, including loss of data, interruptions, or discontinuation of services.
The Game and all Stars and Empires branded products are provided "as-is" without warranties of any kind, express or implied, including fitness for a particular purpose or merchantability.
8. Indemnification
You agree to indemnify and hold Elemental Legion harmless from any claims, losses, or damages, including legal fees, arising from your violation of this EULA or misuse of Stars and Empires: Colony Defense or any Stars and Empires branded products.
9. Governing Law and Dispute Resolution
9.1 Governing Law: This EULA is governed by the laws of [Your Country/State, e.g., Delaware, USA], without regard to conflict of law principles, except where mandatory consumer protection laws apply in your jurisdiction.
