This End User License Agreement ("Agreement") is a legal agreement between you ("End User" or "you") and Tavern Rat Studios ("Tavern Rat Studios," "we," or "us") governing your use of the software game "Mischief" and any related documentation (collectively, the "Game").
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
License Grant
Subject to the terms and conditions of this Agreement, Tavern Rat Studios grants you a limited, non-exclusive, non-transferable license to use the Game for your personal, non-commercial use.
Restrictions
You shall not:
Copy, modify, distribute, sell, sublicense, or lease the Game or any part thereof.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game, except as permitted by applicable law.
Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices contained in or on the Game.
Use the Game for any unlawful purpose or in any manner inconsistent with this Agreement.
Ownership
The Game is licensed, not sold. Tavern Rat Studios retains all right, title, and interest in and to the Game, including all intellectual property rights therein.
Updates
Tavern Rat Studios may, from time to time, release updates, patches, or other modifications to the Game. Your continued use of the Game constitutes your consent to such updates.
Disclaimer of Warranty
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.
Limitation of Liability
IN NO EVENT SHALL TAVERN RAT STUDIOS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE GAME, EVEN IF TAVERN RAT STUDIOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TAVERN RAT STUDIOS' TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU FOR THE GAME.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, USA without regard to its conflicts of law provisions.
Termination
This Agreement is effective until terminated. Tavern Rat Studios may terminate this Agreement at any time if you breach any provision of this Agreement. Upon termination, you shall cease all use of the Game and destroy all copies thereof.
Miscellaneous
This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous agreements or understandings, written or oral, concerning such subject matter.
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Game.
