This End User License Agreement (hereinafter referred to as "this Agreement") is a legal contract between SMOOTHEA CORPORATION (hereinafter referred to as "the Company") and the user (hereinafter referred to as "the User") regarding the use of [Game Name] (hereinafter referred to as "the Game").
By installing, copying, or using the Game, the User is deemed to have agreed to comply with the terms of this Agreement.
1. Grant of License
The Company grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Game for personal, non-commercial purposes, subject to the terms of this Agreement.
The User is permitted to publicly stream or share videos of their gameplay (e.g., on platforms such as YouTube or Twitch) as long as such activities do not involve direct monetization of the Game itself, unless otherwise authorized by the Company.
2. Intellectual Property Rights
All elements of the Game, including but not limited to its content, code, and design, are the property of SMOOTHEA CORPORATION. However, assets distributed under a Creative Commons (CC) license are subject to their respective license terms. The User may not modify, copy, distribute, or reverse engineer the Game.
3. Restrictions
The User agrees not to:
a. Use the Game for commercial purposes.
b. Modify, hack, or exploit the Game in an unauthorized manner.
c. Share or distribute any part or all of the Game to third parties, except in the parts and methods permitted by the Company.
d. Engage in activities that cause inconvenience to other players in public settings such as online play or sharing of user-generated content.
e. Create, share, or publish content that infringes on copyrights, violates public order and morals, or contains discriminatory expressions.
※ If any of the above actions are discovered, the Company reserves the right to limit or suspend the User's access to online features.
4. User-Generated Content (UGC)
Regarding content created or shared by the User within the Game (hereinafter referred to as "User Content"), the following conditions apply:
a. The User guarantees that they possess the necessary rights to the User Content they create.
b. The User grants the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, publish, and create derivative works from the User Content.
c. The Company reserves the right to monitor User Content and, at its sole discretion, delete, modify, or refuse to publish it. However, the Company is not obligated to monitor or remove User Content.
5. Changes and Interruptions to the Service
The Company reserves the right to add, change, suspend, or terminate features of the Game at any time. The Company shall not be liable for any damages incurred by the User due to these changes.
6. Changes to the Agreement
The Company may change the contents of this Agreement. The revised Agreement will be posted on the Company's official website (https://limscape.com) and the Steam sales page. In the case of significant changes, the Company will notify the User through their Steam account. If the User continues to use the Game after the changes, they are deemed to have agreed to the changes.
If the User does not agree to the revised Agreement, they must discontinue the use of the Game.
7. Disclaimer of Warranties
The Game is provided "as is," and the Company makes no warranties regarding the accuracy, reliability, suitability, or completeness of the Game, to the maximum extent permitted by applicable law.
8. Limitation of Liability
The Company shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the Game. Additionally, the Company shall not be responsible for any damage to the User's device, data loss, or security vulnerabilities, to the maximum extent permitted by applicable law.
9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Japan. In the event of any disputes arising from this Agreement, the parties shall engage in sincere discussions to resolve the issue, and if resolution cannot be achieved, the exclusive jurisdiction of the courts of Japan shall apply.
10. Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
11. Entire Agreement
This Agreement constitutes the entire agreement between the parties regarding the Game and supersedes all prior agreements, whether oral or written.
12. Age Restrictions
If the User is a minor, they must obtain the consent of a parent or legal guardian to use the Game.
