END USER LICENSE AGREEMENT (EULA)
By downloading, installing, copying, or otherwise accessing the software titled Top Sellers - E-commerce Simulator (hereinafter referred to as "Software"), published by Lymo Games, you agree to be bound by the terms of this EULA. Please read this agreement carefully. If you do not agree to these terms, you must not use the Software and must immediately uninstall and delete it.
1. Grant of License
Lymo Games grants you a personal, non-transferable, non-exclusive license to use the Software, subject to the terms and conditions of this EULA. This license allows you to download, install, and use the Software solely for personal use. You are not permitted to use the Software for commercial purposes, distribute it, use it in other software, modify it, or create derivative works.
2. Restrictions on Use
The following actions are prohibited under this license:
Using, distributing, renting, selling, or licensing the Software for commercial purposes.
Reverse-engineering, decompiling, disassembling, or attempting to extract the source code of the Software.
Modifying, copying, or redistributing the Software in any unauthorized manner.
Altering or manipulating the Software in a way that may introduce viruses or other malicious software.
3. Ownership
The Software and all related content (graphics, code, audio, documents, logos, and other elements) are owned by Lymo Games and are protected by copyright, trademarks, patents, and other intellectual property laws. This EULA does not transfer ownership of the Software, and all rights to the Software remain with Lymo Games.
4. Updates and Upgrades
Lymo Games reserves the right to provide updates, patches, or upgrades to the Software. These updates, if any, will be governed by the terms of this EULA.
5. Disclaimer of Warranty and Limitation of Liability
The Software is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Lymo Games does not guarantee that the Software will be error-free, secure, or function without interruptions. You use the Software at your own risk, and Lymo Games will not be liable for any damages arising from the use of the Software, including but not limited to any direct, indirect, incidental, or consequential damages.
6. Data Collection and Privacy
The Software may collect and process certain personal data in accordance with Lymo Games’ Privacy Policy. By using the Software, you agree to the terms of the Privacy Policy. The Privacy Policy is available on Lymo Games’ website or within the Software itself.
7. Termination
This EULA will terminate automatically if you breach any of its terms. Additionally, you may terminate this EULA by ceasing use of the Software and uninstalling it. Upon termination, you must delete all copies of the Software from your devices.
8. Governing Law
This EULA shall be governed by and construed in accordance with the laws of Estonia. In the event of any disputes, the courts of [City, Estonia] shall have exclusive jurisdiction.
9. Modifications
Lymo Games reserves the right to modify or amend this EULA at any time. Any changes to the EULA will become effective upon their posting on Lymo Games’ website or within the Software. Your continued use of the Software after such modifications constitutes your acceptance of the updated terms.
10. Entire Agreement
This EULA constitutes the entire agreement between the parties concerning the use of the Software and supersedes any prior agreements, written or oral, relating to the Software.
