Terms of Service for Heat incremental

1. Acceptance of Terms
By downloading, accessing, or playing Heat incremental (“the Game”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree with these Terms, please do not use the Game.
2. Use of the Game
The Game is available online via a browser-based version and as a downloadable client. It is offered on a free-to-play basis with optional in-app purchases. You agree to use the Game in accordance with all applicable laws and these Terms.
3. In-App Purchases and Payment
The Game provides in-app purchases through multiple channels, including third-party platforms (Kongregate, ArmorGames, Steam) and our direct integrations (PayPal, Stripe). All transactions processed via these channels are final. Payment terms and any applicable fees are determined by the respective payment processors. 4. Local and Cloud Data Storage
The Game uses local storage (e.g., browser localstorage or similar mechanisms) to save your game state on your device. In addition, the Game uses cloud storage to back up your game state and for behavioral analysis. Any data stored in the cloud is processed in accordance with our Privacy Policy.
5. Intellectual Property Rights
All content within the Game—including graphics, text, logos, and software—is owned by Grest Games OÜ or its licensors. Unauthorized copying, distribution, or modification of this content is prohibited.
6. User Conduct
You agree to refrain from any activity that could disrupt or interfere with the Game’s operation. Harassing, fraudulent, or otherwise harmful behavior may result in termination of your access to the Game.
7. Refunds and Cancellation
All in-app purchase transactions are final. Refunds will only be provided as required by applicable law or the policies of the respective payment processors.
8. Termination
We reserve the right to suspend or terminate your access to the Game at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Game or its users.
9. Updates and Changes to the Game
We may update or modify the Game at any time without prior notice. Such updates may include changes to game features, data storage methods, or functionality. Your continued use of the Game after such updates constitutes your acceptance of the changes.
10. Dispute Resolution
Any disputes arising under these Terms shall be resolved exclusively in the courts of Estonia. Prior to initiating legal action, both parties agree to attempt to resolve any dispute through mediation. If mediation does not result in a resolution, the dispute may be submitted to the courts as stated above.
11. Indemnification
You agree to indemnify and hold harmless Grest Games OÜ, its affiliates, and its respective officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Game or your violation of these Terms.
12. User-Generated Content
If the Game allows for user-generated content, you grant Grest Games OÜ a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, reproduce, modify, and display such content in connection with the Game. You are solely responsible for any content you upload or share, and you agree not to post any content that violates any laws or these Terms.

The Game is provided “as is” without any warranties, express or implied. We do not guarantee uninterrupted or error-free service, and you use the Game at your own risk.
14. Limitation of Liability
Grest Games OÜ is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Game. Our total liability shall not exceed any fees you may have paid to access the Game.
